Behind on Payments? Sell Before Foreclosure

Falling behind on a mortgage happens to careful people. Medical bills, a lost job, a divorce, an insurance premium that doubled. There's no shame in it. What matters now is that you still have options, and the sooner you use them, the more of them you have.

    • Loan paid off at closing
    • Close in as little as 7 days
    • Private, no showings
Mario Zendeli, founder of ZenMar Homes

Hi, I'm Mario Zendeli. I've been buying houses here in Central Florida since 2010. I'll walk the house with you myself, and my team and I are the ones who buy it.

    The challenge

    What makes this hard

    1. 01

Every month adds fees to what you owe

Once payments are missed, the letters start, then the calls, then a lawsuit. Every month adds late fees, legal fees, and interest to what you owe. The equity you built over years shrinks while you wait for something to change.

    2. 02

Waiting is what the timeline punishes

It's natural to want to put the letters in a drawer. But waiting is exactly what the timeline punishes. A house that could have sold with money left over becomes a house sold at auction for whatever it brings, and you could still owe the difference.

    3. 03

A listing is too slow and too fragile

A traditional listing takes too long. Getting the house ready, waiting for showings, and then waiting on a buyer's loan approval can eat sixty to ninety days you may not have. Any sale that depends on someone else's lender can fall through the week before the court date.

    The solution

How a cash sale solves it

No repairs, no financing, a real closing date

A cash sale takes away the two things you can't control: repairs and financing. We buy the house as it stands and close on our own funds, so the closing date is real. In many cases we can close in as little as seven days from a signed contract.

Your lender is paid from the proceeds

At closing, the title company pays your lender directly from the sale proceeds, including the missed payments, fees, and interest. Whatever's left is yours. If the numbers are tight, I'll tell you plainly before you sign anything, and I'll show you the math.

We get the payoff figure so the math is right

We work with your lender or their attorney to get a current payoff figure, so the closing statement is right the first time. You don't have to deal with them alone anymore.

    Working together

    What we'll need from you

Missing paperwork is normal. Bring what you have and we'll help track down the rest.

    • Your most recent mortgage statement and any letters from the lender or their attorney, especially anything with a court date on it.
    • A rough idea of what else is owed on the house: a second mortgage, HOA dues, property taxes, or a lien.
    • Permission to request a payoff statement from your lender for you.
    • A time for one walkthrough. The condition of the house doesn't change whether we buy it.

    Local rules

    Florida-specific notes

What tends to surprise the sellers I meet in Seminole, Orange, and Osceola County.

This is general information, not legal or tax advice.

    Judicial state
Florida is a judicial foreclosure state. The lender has to file a lawsuit and get a judgment before the house can be sold at auction. That takes time, and until the sale is final you still own the house and can sell it.
    Lis pendens
When the lender files, a lis pendens is recorded against the property. It doesn't stop a sale, but it means the clock is running. If you've received one, call me that week, not next month.
    Payoff and short sales
The full payoff, including fees and interest, is settled at closing through the title company. If the sale price won't cover everything owed, that's a short sale and needs the lender's approval. We can help you figure out which situation you're in.
    Any shortfall
Whether a lender can come after you for any shortfall after a sale depends on the specifics. That's a question for an attorney, and I'll say so rather than guess.
